1.1. Central Registry
a database of all Domain Names with the .CZ country code, their holders and other persons.
1.2. CZ.NIC
a voluntary association of companies. The association runs the Central Registry for .CZ domains.
1.3. Delegated Domain Name
a registered Domain Name with a record on the primary name server (in a so-called .CZ zone).
1.4. Registration Date
the date on which a Domain Name is entered in the Central Registry.
1.5. Expiration Date
the date following the day on which the period for which a Domain Name has been registered ends.
1.6. ccTLD .cz
a country code Top Level Domain of Czech Republic.
1.7. Domain Name
a second-level domain, under the .CZ domain, formed by a combination of permitted characters.
1.8. Holder
an individual or a company that has a Domain Name registered for himself/itself.
1.9. Electronic signature
electronic data as defined in the Law on Electronic Signature (law no. 227/2000 Coll.)
1.10. ACTIVE 24
a limited-liability company, ID: 25115804, head-quartered at, Sokolovská 394/17, 186 00, Praha 8.
1.11. Contact
the record of specific person (individual or legal entity) kept at central registry. The Contact can be admin, technical or like a owner.
1.12 Rules of Alternative Dispute Resolution
a document published by CZ.NIC, containing the Holder’s public proposal of arbitration, which forms an integral part of the Rules of Registration.
1.13. Registration Rules
Rules of the Registration of Domain Names in the .CZ Domain, published by CZ.NIC and available HERE.
1.14. Registrar
an entity empowered to access the Central Registry in a defined way and to place requests for changes to records kept at the Central Registry. Each Domain Name has a single Registrar at a single moment. Holders can make changes at the Central Registry only by means of a Registrar.
1.15. Key Set
a record file containing at least one DS (Delegation Signer record according to RFC4034 intended for secure delegation of the domain name by means of the DNSSEC technology and at least one technical Contact.
1.16. Nameserver's set (NSSET)
the record of the list containing at least the 2 name servers and at least the one technical Contact.
1.17. Designated Registrar
a Registrar for a specific Domain Name designated by the Holder. Each registered Domain Name has precisely one Designated Registrar. The ACTIVE 24 company is the Registrar for domains registered on the basis of this document.
1.18. Secure Electronic Communication
communication by means of the public Internet computer network, using safe data transfer protocols (HTTP/SSL) implemented according to the relevant RFC.
1.19. Secure Electronic Signature
electronic data as defined in the Law on Electronic Signature (law no. 227/2000 Coll.)
1.20. Applicant
an individual or company filing an application for registration, renewal, modification or Domain Name transfer.
2. OPENING PROVISIONS
2.1. This document sets the Rules of Domain Name Registration by Means of ACTIVE 24 as a Designated Registrar (hereafter "Rules"). ACTIVE 24 has the status of Registrar, granted by the CZ.NIC association on October 2, 2003.
2.2.These Rules relate to all Domain Names for which ACTIVE 24 is the Designated Registrar.
2.3. The conditions for providing services in accord with these Rules that are not explicitly treated in the Rules conform to the valid GCC of ACTIVE 24 and to the Rules of the Registration of Domain Names in the .CZ Domain.
2.4. The terms treated as names with capital letters have, for the purpose of these Rules, the meaning assigned to them in section 1 or in the Rules of the Registration of Domain Names in the .CZ Domain.
2.5. ACTIVE 24 becomes the Designated Registrar:
2.5.1. on the basis of the Holder's application upon the registration of a Domain Name;
2.5.2. on the basis of the Holder's request for a change of Designated Registrar for the registered Domain Name;
2.5.3. provided that on the day fixed by the CZ.NIC association as the date for a shift in the Domain Name administration system under the .CZ domain to a decentralised model, ACTIVE 24 is registered as the subject of the payer (IDACC) and ACTIVE 24 applies to be registered as the Registrar for this Domain Name.
2.6. ACTIVE 24 ceases to be the Designated Registrar on the basis of the Holder's request for a change of the Designated Registrar for the registered Domain Name.
2.7. The Applicant acknowledges and agrees that all data provided to the ACTIVE 24 Registrar are also accessible to the CZ.NIC association.
3. DOMAIN NAME REGISTRATION
3.1. By means of ACTIVE 24, it is possible to register a Domain Name for a period of one to ten years.
3.2. On the basis of an application for the registration of a Domain Name, ACTIVE 24 informs the Applicant whether the required Domain Name is registered at the time the application is filed. If it is not registered, ACTIVE 24 will accept the order and will call on the Applicant to make an advance payment of the given price.
3.3. The Applicant must cover the advance payment in the way and with the identification specified in the receipt notice.
3.4. If the Applicant fails to cover the advance payment in the required way and with the required identification within 21 days after the application for registration has been accepted, ACTIVE 24 will cancel the application for the registration of a Domain Name on the next day and will inform the Applicant about the step.
3.5. Throughout the maturity period on the advance payment, the Registrar does not block the Domain Name on the Applicant's behalf. The day ACTIVE 24's bank account is credited with the advance payment is also the Registration Date for the domain.
3.6. If more applications for a registration of the same Domain Name are filed by means of ACTIVE 24, the registration will be granted on a first come, first served basis, depending on the date that ACTIVE 24's account has been credited with the advance payment. ACTIVE 24 will repay the advance payment to those Applicants who made the payment later.
3.7. If a check carried out in accord with paragraph 3.2 reveals the Domain Name has already been registered, ACTIVE 24 will inform the Applicant about the fact and will repay the advance payment to the Applicant. ACTIVE 24 does not guarantee that the required Domain Name will not be registered by means of another Designated Registrar between the date the application was filed and the end of the period according to paragraph 3.4.
3.8. The Applicant must agree with the contents of the Registration Rules in writing. The person who submits the Applicant's approval of the latest version of the Registration Rules in relation to an application for the registration of a Domain Name declares he/she is entitled to act in the Applicant's name in this matter
3.9. It is agreed that the condition of "in writing" is met if communication takes place by means of wire or electronic communication which enables the contents of the communication to be taken down and the people communicating to be identified.
4. REGISTRATION RENEWAL
4.1. In a period of 45 days before Expiration Date, ACTIVE 24 will call on the Holder to pay a fee for the renewal of Domain Name registration.
4.2. If asking for a renewal of the Domain Name registration, the Holder must agree with the contents of the Registration Rules in writing and pay the renewal fee in the way and with the identification specified in the receipt notice.
5. TRANSFERRING A DOMAIN NAME
5.1. Changes to data concerning the Domain Name and Holder Contact can be made by means of ACTIVE 24 only if ACTIVE 24 is the Designated Registrar for the given Domain Name.
5.2. Changes are made upon request. The process of modifying the individual data is described on http://www.domain.cz.
6. TRANSFERRING A DOMAIN NAME
6.1. A change of the Holder (a transfer of the Domain Name) can be made by means of ACTIVE 24 only with Domain Names for which ACTIVE 24 is the Designated Registrar.
6.2. To transfer a Domain Name, ACTIVE 24 needs an order from both the original Holder and the future Holder of the Domain Name. The future Holder of the Domain Name must agree with the contents of the Registration Rules in writing.
7. CHANGING THE DESIGNATED REGISTRAR
7.1. The Holder is entitled to change the Designated Registrar at any time, immediately and free of charge. However, the Holder cannot stake any claim to a compensation for prepaid and still-unused services provided by the ACTIVE 24 Registrar.
7.2. In case the Domain Name is registered with another Designated Registrar, its transfer to the ACTIVE 24 Registrar conforms to the Registration Rules of CZ.NIC.
8. PRICES
8.1. The price of the individual services provided in accord with these Rules to the Holder is fixed in the price list of the DOMÉNY.CZ service of the ACTIVE 24 company on http://price.domain.cz.
8.2. Prices for ACTIVE 24's trading partners implementing group registrations of domains for their clients are fixed in a partnership agreement.
8.3. Unless otherwise stated, the price for the individual services is paid before the relevant service is provided, in the way and with the identification specified in the receipt notice sent to the Holder by e-mail on the basis of a request for the given service.
8.4. It is understood that all payments are made on the day the ACTIVE 24 account is credited with the relevant sum, on condition that the following data are correct: the sum and payment identification (the variable symbol).
8.5. ACTIVE 24 will issue a receipt and send it to the Applicant's e-mail address or, upon request, mailing address, or to another address given by the Applicant, within 14 days after the price was paid.
9. MUTUAL COMMUNICATION
9.1. The communication between ACTIVE 24 and the Holder is primarily electronic with the use of e-mail addresses defined by the Holder and stored in ACTIVE 24's client database.
9.2. ACTIVE 24 accepts applications for registration or changes only in an electronic form, either by means of a website run by ACTIVE 24 or by means of electronic mail.
9.3. Authenticity is verified:
9.3.1. personally upon the presentation of a valid ID and another identification card (a valid passport, birth certificate or driving licence).
9.3.2. by e-mail with the use of a Secured Electronic Signature. A list of acknowledged certification authorities is available on http://ca.domain.cz.
9.3.3. by Secured Electronic Communication through a web form using Authentication Data.
9.3.4. in writing with signatures of the authorised individuals officially verified. Documents with an officially verified signature of an authorised person must be delivered to ACTIVE 24 in the original or an officially verified copy. If the Holder is a company, it must submit the original or an officially verified copy of its extract from the Register of Companies or another similar registry. If the Holder has a proxy, the proxy must submit the original or a verified copy of a Power of Attorney with an officially verified signature.
9.4. If the Holder submits to ACTIVE 24 a document in a language other than Czech or Slovak, the document must be supplemented with an officially verified translation into Czech, including potential verification riders.
10. DISPUTES
10.1. If the Holder and ACTIVE 24 do not agree on the settlement of a mutual dispute concerning the Domain Name, each of the parties has the right to submit the dispute to the arbitration court at the Czech Economic Chamber and the Czech Agrarian Chamber.
10.2. The arbitration process will be led by three arbitrators in Prague in the Czech language according to the rules of the said arbitration court.
10.3. The award sentence is final and binding for the contractual parties.
11. ARBITRATION PUBLIC BID
11.1. The Holder irrevocably publicly submits to the authority of the Court of Arbitration at the Czech Economic Chamber and the Czech Agrarian Chamber, hereafter "Court of Arbitration", in arbitration proceedings at this Court of Arbitration according to its rules as published in the Commercial Bulletin in a property dispute that can be settled and in which a third person attacks the Holder's Domain Name included in the electronic database of Domain Names in the "cz" national domain run by the CZ.NIC association if the third person expresses in written form to the Holder the will to submit to the authority of this Court of Arbitration in the given matter in particular by starting such a dispute at this Court of Arbitration in writing.
11.2. The right of any party to file for a court injunction with the court remains untouched.
12. FINAL PROVISIONS
12.1. The current wording of the Rules is available on http://rules.domain.cz.
12.2. ACTIVE 24 must make public any change to the documents cited in paragraph 11.1 on http://www.domain.cz at least 30 days before such a change comes into force.
12.3. Relations to Domain Names registered before a change to the documents cited in paragraph 11.1 and the rights and duties of ACTIVE 24 and the Holder conform to the new wording of the Rules as of the date of renewal of these Domain Names.
